Terms of Contracts TOC
Welcome to CompleteMore!
Your relationship with CompleteMore and Website & Software Engineering WSSWE
will be defined by the Terms of Services TOS and Terms of Contracts TOC
documents. No other agreements or definitions are acceptable outside of these
documents unless clearly and expressly written by, agreed to, and signed by a
legal representative of WSSWE. By utilizing our services or products you agree
to these terms.
The Terms of Contracts TOC document defines certain service level agreement
services. By using our services, free services, paid services, or services in
general you agree to the TOC and that no other agreements exist that were not
clearly and expressly written by, agreed to, and signed by a legal
representative of WSSWE.
WSSWE provides free accounts that are limited by space, disk space, database
space, number of links, and other services are limited via basic and free
accounts offered through CompleteMore.com website. You agree that WSSWE and
CompleteMore has the right to alter the terms of it's legal documents and that
new additions or edits are binding and overrule previous versions at the
discretion of WSSWE and CompleteMore. You also agree that WSSWE and CompleteMore
does not have to define or specify any exact or specific amounts as these
figures are subject to change at any given time with or without written or other
communication or updates from WSSWE or CompleteMore to you the client(s).
A mockup design, custom web mockup, web graphic mockup, graphic mockup, mockup,
or website example is defined as: a non-working non-interactive graphic used to
depict a projected or proposed direction. The mockup design may or may not be
the vision of the client. Basic service that includes mockup design is limited
to one design and clients are given 3 edit iterations or chances to make changes
in such a way that moves the mockup closer to the client's vision. Clients do
not have unlimited number of edit alterations. Client agrees to pay for any
additional alterations beyond the 3 count at a service price chosen by WSSWE or
CompleteMore. No negotiations are allowed unless paid for by client. All
services are bound by contract and invoice receipts. No verbal agreements are
binding and client agrees that verbal agreements do not exist with relation to
CompleteMore and WSSWE.
At its discretion WSSWE and CompleteMore may create a free basic logo for use by
client. Client agrees that the free basic logo is not always graphically
pleasing or designed with detail; however, client agrees that they can pay for a
more advanced custom logo if the free version is not enough. Logos and custom
logos can take anywhere from 2-45 days or more to create.
Client understands the more detail involved requires more time and attention and
clients agrees to pay for such time and any costs associated with accomplishing
the clients requirements for any design work at a cost chosen by WSSWE or
CompleteMore. Costs may be hourly, weekly, monthly, or annually as chosen by
WSSWE or CompleteMore and all costs are to be paid by client at time of invoice.
No exceptions because some consultation, research, or work has either already
started or is already complete by time of invoice.
Client agree and understands that WSSWE may charge separate prices for hosting
on CompleteMore than hosting on other servers or content management systems.
Client also understands that costs associated with CompleteMore may be
relatively less; however, client also agrees that any prices or costs are chosen
by WSSWE and CompleteMore and client agrees to pay and be bound by such chosen
cost.
Client agrees that WSSWE and CompleteMore may charge additional for implementing
or converting a mockup into a live prototype or working website or other body of
work.
A custom web design and template is defined as: the very basic and general look,
overview, outline, feel, interaction elements, and user interface elements of a
website. A custom web design is often associated with the work required in
converting the web graphic mockup into the foundation or working structure of a
website.
A custom web page mockup design and custom web page design are defined as:
a mockup design that depicts an individual link or page in a website and the
work required to convert that page mockup into a live prototype or working web
page. Client agrees that WSSWE and CompleteMore charges separately and in
addition to these services or other services acquired by client. Client agrees
that web page mockups also have 3 edit iterations and any additional iterations
will be charged and paid for by client at a price chosen by WSSWE and
CompleteMore.
Client agrees and understands that refunds are not given on design work because
of or a combination of but not limited to: initial consultation, starting tasks,
research, work has already started or work is already complete at time of
invoice.
A web page template is also defined as: a general or specific look and feel of a
specific link on a website and not the overal web site template. Client agrees
that creating web page templates are billable and paid for by client via invoice
at time and cost chosen by WSSWE or CompleteMore. Client agrees that client is
responsible for overall quality of web pages, supplying and creating content,
creating links, and any other work and costs associated with designing or
implementing custom web page templates.
Client agrees to not remove or alter any work, text, watermarks, pages, links,
documents, or other that have either marketing or branding of Website & Software
Engineering or of CompleteMore including header, footer, or other text that
refers to WSSWE or CompleteMore.com websites or "services offered by" and
"services provided by".
Creating an account on any service related to, owned by, or maintained by
Website & Software Engineering does not define terms of employment and does not
guarantee employment, nor does it extent any warranties or responsibility of
liabilities, of any kind. All and any such claim of working with, for, under, or
over Website & Software Engineering must be legally bound via writing (never by
word of mouth) by the owner of Website & Software Engineering (the owner of this
website service) and it must include a non photocopied and non duplicated
signature by the owner of Website & Software Engineering. All works created for
application on or through a Website & Software Engineering platform will remain
the ownership of Website & Software Engineering at all times unless person who
handled or transferred the material over to Website & Software Engineering has
done so using licensed material that belongs to another party at which point the
handler, transferer, or you, of that material (design, planning, or otherwise)
will be held 100% liable and responsible in any and all courts to answering for
such copyrighted material.
If you are a contractor acquired to fulfill contract work and placed on
assignment through or by Website & Software Engineering then you understand that
you are placed on assignment to represent Website & Software Engineering and
that you will be paid by Website & Software Engineering. You agree to wear
professional attire that is subject to approval by Website & Softare Engineering
and such attire must NEVER have logos or words on them that are not written as
"Website & Software Engineering". You agree to work for the duration of the
assignment and that you will arrive on time and stay till the end of the day.
You are responsible for contacting Website & Software Engineering daily to
review your work progress and you will also need to submit via fax or email a
daily journal of work performed and times fulfilled. You agree and understand
that you are fully responsible for paying your own taxes, federal taxes, local
taxes, state taxes, medical, social security, aids and other expenses not
explicity listed here, automobile expenses included mileage on gas before and
after driving, airfare, lodging, inbetween, to, from, near, and far. You agree
that this contract is greater than any other agreements or contracts within your
locality, state, or elsewhere. You agree to fulfill the entire work order from
start to finish and that if you leave early before the entire project is
complete then you are legally liable and responsible for paying to Website &
Software Engineering any fees and all costs related to your leave including time
and expenses takent to find a replacement, and etc and must be paid to Website &
Software Engineering within 5 business days.
Contractors agree to only push the brand of Website & Software Engineering and
to never discuss contracts with the client for whom they have been placed on
site to fulfill work orders. Contractors agree to not solicit the clients and to
immediately forward clients to Website & Software Engineering in event of any
questioning about services, contracts, payments, or otherwise. Contractor agrees
to only fulfill work that is assigned to them via mutual agreement between
Website & Software Engineering and the client. Contractor must to be responsible
for all fees or charges that are assessed via the client for which is requested
for payment by client due to the contractors negligence, responsiblity,
interaction, or other expenses etc. If contractor assumes a position with the
client after 24 months or other maximum time as permitted by law then contractor
will pay Website & Software Engineering 30% of total earnings for 12 months to
be paid off at end of every month starting at the first date of either
employment or other contracting or other agreements.
